The terms that govern use of MX4 Atlas and related services.

Acceptance and eligibility

By accessing or using MX4 AI services, you agree to these Terms. You represent that you are at least 18 years old and authorized to bind your organization.

Services overview

MX4 Atlas orchestrates AI infrastructure on customer systems. Production deployments run on customer infrastructure. The Test Access Program is a hosted evaluation; Free POC Pilot deploys on your infrastructure for evaluation.

Accounts and security

You are responsible for safeguarding credentials and for all activity under your account. You must notify us promptly of any unauthorized use.

Acceptable use

You agree not to use the services to:

Violate any law or third‑party rights
Interfere with or disrupt service integrity or security
Reverse engineer or attempt to extract source code
Build or benchmark a competing product without permission
Transmit malware or harmful content

Customer data and privacy

You remain responsible for the data you submit. You acknowledge that:

You have the rights and permissions to use submitted data
You are responsible for the legality of data and prompts
We process data to provide and improve services in line with our Privacy Policy

Evaluation programs

Test Access and Free POC are non‑production evaluation programs:

Use test or synthetic data where possible
No production SLA applies unless agreed in writing
We may modify or discontinue evaluation programs at any time

Fees and taxes

Fees, payment terms, and taxes (if any) are defined in your enterprise agreement or order form. You are responsible for applicable taxes.

Third‑party services

Our services may integrate with or link to third‑party services. We are not responsible for third‑party content or practices, and your use of third‑party services is governed by their terms.

Intellectual property

All content, features, and functionality of the services are the property of MX4 AI or its licensors and are protected by applicable intellectual property laws.

Confidentiality

Any non‑public information shared between the parties must be treated as confidential and used only for permitted purposes.

Disclaimer of warranties

To the maximum extent permitted by law, the services are provided on an “as is” and “as available” basis. We disclaim warranties including:

Fitness for a particular purpose and non‑infringement
Uninterrupted, secure, or error‑free operation
Accuracy or suitability of outputs for a specific use

Limitation of liability

To the maximum extent permitted by law:

MX4 AI is not liable for indirect, incidental, special, or consequential damages
Total liability is limited to the lesser of fees paid in the prior 12 months or USD $100
Some jurisdictions do not allow certain limitations, so parts may not apply

Indemnification

You agree to indemnify and hold MX4 AI harmless from claims arising from your use of the services or violation of these Terms.

Termination

We may suspend or terminate access for violations of these Terms. Provisions that should survive termination will survive, including IP, warranty disclaimers, indemnity, and limitations of liability.

Governing law and disputes

These Terms are governed by the laws of Morocco. Disputes are subject to the exclusive jurisdiction of the courts of Morocco.

If an enterprise agreement conflicts with these Terms, the enterprise agreement controls.

Changes to terms

We may update these Terms from time to time. Updated terms will be posted on this page with a revised date.
