1. Acceptance of Terms

To the maximum extent permitted by applicable law:

• MX4 AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services
• Our total liability for all claims related to these terms shall not exceed the amount paid by you, if any, for accessing our services during the three months preceding the claim
• Nothing in these terms excludes or limits our liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by our negligence

You agree to indemnify, defend, and hold harmless MX4 AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising from or in any way related to your use of our services or violation of these terms.

9. Governing Law and Dispute Resolution

These terms are governed by the laws of Morocco without regard to its conflict of law provisions. Any dispute arising out of or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of Morocco.

Before initiating any legal proceedings, both parties agree to attempt in good faith to resolve the dispute through negotiation. If negotiation fails, the parties will seek mediation through a mutually agreed mediator.

10. Changes to Terms

MX4 AI reserves the right to modify these terms at any time. We will provide notice of any material changes by posting the updated terms on our website and updating the "Last updated" date. Your continued use of our services after such changes constitutes your acceptance of the modified terms.

11. Termination

MX4 AI may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including without limitation if you breach these terms. Upon termination, your right to use our services will immediately cease. All provisions of these terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
