Terms of service

The terms that govern use of MX4 Atlas and related services.

Acceptance of Terms

By accessing MX4 AI's website and services, you agree to these Terms of Service and to comply with applicable laws and regulations in Morocco and your jurisdiction.

License and Access

MX4 AI grants you a limited, non-exclusive, non-transferable license to access and use our services for internal business purposes, subject to the following restrictions:

  • Do not resell, sublicense, or provide access to third parties without written permission
  • Do not reverse engineer or attempt to extract source code
  • Do not interfere with or disrupt service integrity or security
  • Do not use the services to build a competing product
  • Do not use the services for unlawful or prohibited purposes

Acceptable Use

Your use of the services is subject to our Acceptable Use Policy, which forms part of these Terms.

Customer Data and Privacy

Your use of our services is governed by our Privacy Policy. You acknowledge that:

  • You have the rights and permissions to submit the data you provide
  • You remain responsible for the content and legality of data you submit
  • We process data to provide and improve the services in accordance with our Privacy Policy

Evaluation Programs

The Test Access Program and Free POC Pilot are evaluation programs designed for non-production use:

  • Use test or synthetic data where possible
  • No production SLA applies unless explicitly agreed in writing
  • We may modify or discontinue evaluation programs at any time

Service Availability and Changes

We may update, modify, or discontinue any part of our services with reasonable notice where practicable. We are not liable for modifications or discontinuance, provided we make reasonable efforts to inform you of significant changes.

Third-Party Services

Our services may integrate with or link to third-party services. We are not responsible for third-party content, availability, or practices, and your use of third-party services is governed by their terms.

Intellectual Property

All content, features, and functionality of our services are the exclusive property of MX4 AI or its licensors and are protected by Moroccan and international intellectual property laws. Unauthorized use, reproduction, modification, distribution, or duplication of any content is strictly prohibited.

Disclaimer of Warranties

To the maximum extent permitted by law, the services are provided on an "as is" and "as available" basis. We disclaim all warranties, including:

  • Any implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • That the services will be uninterrupted, secure, or error-free
  • That outputs will be accurate or fit for a specific use

Limitation of Liability

To the maximum extent permitted by applicable law:

  • MX4 AI shall not be liable for any indirect, incidental, special, or consequential damages
  • Our total liability for all claims shall not exceed the fees paid by you in the preceding three months
  • If no fees were paid, liability is limited to USD $100

Indemnification

You agree to indemnify, defend, and hold harmless MX4 AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising from or related to your use of our services or violation of these terms.

Export Controls and Sanctions

You agree to comply with applicable export control and sanctions laws. You may not use the services where prohibited by law.

Governing Law and Dispute Resolution

These terms are governed by the laws of Morocco. Any dispute shall be subject to the exclusive jurisdiction of the courts of Morocco.

Before initiating legal proceedings, both parties agree to attempt in good faith to resolve the dispute through negotiation and mediation.

Changes to Terms

MX4 AI reserves the right to modify these terms at any time. We will provide notice of any material changes by posting the updated terms on our website. Your continued use of our services after such changes constitutes your acceptance of the modified terms.

Termination

MX4 AI may terminate or suspend your access to our services immediately, without prior notice, for any reason including violation of these terms. All provisions which by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.
